These Terms of Service ("Terms") govern your use of the Pocket Dispatcher platform operated by Pocket Dispatcher LLC ("we," "us," or "our"). By accessing or using our web application, mobile app, or services, you agree to be bound by these Terms and our Privacy Policy.

Our services are available only within the United States. We actively block access from users located outside the United States. If you attempt to access our services from outside the US, your access will be restricted.
When creating an account, you must provide accurate, current, and complete information including:
Phone Verification: All users must verify their phone number through our SMS verification system.
Address Verification: We may manually verify addresses provided during registration.
DOT/MC Number Verification: By providing DOT and MC numbers, you represent and warrant that:
IMPORTANT: We do NOT independently verify DOT or MC numbers due to the cost and complexity of verification services. You are solely responsible for the accuracy of this information. Providing false or unauthorized DOT/MC numbers may result in immediate account termination and potential legal action.

Drivers can browse loads on our public load board but must be logged in to apply for loads through the mobile app.
When a driver submits an application for a specific load, they must pay a non-refundable application fee of $49.99. This fee is charged regardless of whether the application is accepted or rejected by the broker.
All payments are processed securely through our third-party payment processor. By submitting payment information, you agree to our payment processor's terms of service and privacy policy.

Brokers and drivers may only communicate through our platform's messaging system and only after a load has been assigned to the driver.

Paying the application fee does not guarantee load assignment. Brokers have sole discretion in selecting drivers for their loads.
In the event of disputes between brokers and drivers, we may facilitate communication and attempt to help parties reach a resolution. However, we are not obligated to resolve disputes and do not guarantee any particular outcome.
Each dispute will be handled individually based on the specific circumstances. We reserve the right to determine appropriate actions, which may include:
We are not a party to the transportation contracts between brokers and drivers and assume no liability for the performance or non-performance of such contracts.
We provide our platform "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
We strive to maintain platform availability but do not guarantee continuous, uninterrupted access. We may suspend or terminate services for maintenance, updates, or other operational reasons.
We are not responsible for the accuracy, reliability, or legality of information posted by users, including load details, company information, or communications.

You agree to indemnify, defend, and hold harmless Pocket Dispatcher LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
The Pocket Dispatcher platform, including its design, features, functionality, and content, is owned by Pocket Dispatcher LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform.
You retain ownership of any content you submit to our platform. However, by submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content as necessary to provide our services.
Any feedback, suggestions, or ideas you provide about our services become our property and may be used without compensation to you.
Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information. By using our services, you agree to our Privacy Policy.
You may terminate your account at any time by contacting us at admin@pocketdispatcher.com. Upon termination, your data will be deleted within 2-3 business days as outlined in our Privacy Policy.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or technical failures.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state where Pocket Dispatcher LLC is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in that state.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pocket Dispatcher LLC regarding your use of our services and supersede all prior agreements and understandings.
We may modify these Terms at any time by posting the updated Terms on our platform. Changes will be effective immediately upon posting, unless otherwise specified. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
